Einwegkunststofffonds-Abgabe / Single Used plastic fee Die EU-Richtlinie 2019/904 wurde durch das neue Einwegkunststoff fondsgesetz (EWKFondsG) in Deutschland in nationalas Recht umgesetzt. Das EWKFondsG und die damit verbundene Verordnung zu den Kostensätzen tritt ab dem 1.1.2024 in Kraft. Demnach muss für alle Ballons, welche 2024 erstmals in Deutschland auf dem Markt bereit gestellt werden, eine Abagbe von 4,34 EURO/Kg Ballon durch den Hersteller oder Importeur an das Bundesumweltamt abgeführt werden. Jeder inländische Hersteller oder Importeur unterliegt einer Registrierungspfl icht und muss Anfang 2025 eine durch einen Sachverständigen geprüfte Mengenmeldung beim Bundesumwelt einreichen und den darauf folgenden Gebührenbescheid begleichen. Was bedeutet dies für Händler ? Als Deutscher Kunde der Karaloon-Marke : Nichts! Wir über- nehmen alle Herstellerpfl ichten des EWKFondsGs, von der Registierung bis hin zum Gebührenbegleich. Damit Ballons bezahlbar bleiben, werden wir für die Karaloonmarke 2024 keinerlei Preise in unserer Standardpreisliste erhöhen. Sie importieren Ballons nach Deutschland? Dann sind Sie, unabhängig davon, wer der ursrpüngliche Hersteller ist, für die Wahrnehmung der Herstellerpfl ichten selbst verantwortlich, inklusive der Gebührenabgabe. Sie exportieren Ballons ins Europäische Ausland ? Beachten Sie unbedingt die dortigen nationalen Re- gelungen, denn bis Ende 2024 müssen aller EU-Länder die Richtlinie in natioanles Recht umsetzen. Ihr ausländischer Kunde oder Ihre Filiale ist in diesem Fall für die Wahrnehmung der dortigen Herstellerpfl ichten verantwortlich. Ausländische Hersteller oder Händler, welche Ballons direkt an deutsche Endverbaucher verkaufen, müssen einen in Deutschland niedergelassenen Bevollmächtigten ernennen. Sie bleiben jedoch für die Wahrnehmung der Herstellerpfl ichten selbst verantwortlich. Da die Höhe der Abgaben auf kommunalen Abfallanalysen basiert, sollten wir gemeinsam den Endverbaucher dazu sensibilisieren, Ballons nicht fl iegen zu lassen oder achtlos in die Umwelt zu entsorgen. Denn je mehr Ballons gefunden werden, desto teuerer wird die Abgabe. 2026 werden die Abfalldaten neu erhoben und höhere Mengen würden zwangsläufi g zu einer unumgänglichen Erhöhung der Preise führen. The EU Directive 2019/904 was transposed into national law in Germany by the new Single-Use Plastics Fund Act (EWKFondsG). The EWK- FondsG and the associated ordinance on cost rates will come into force on 1 January 2024. Accordingly, a levy of 4.34 EURO/kg balloon must be paid by the manufacturer or importer to the Federal Environment Agency for all balloons that are made available on the market in Germa- ny for the fi rst time in 2024. Every German manufacturer or importer is subject to a registration obligation and must submit a quantity report to the Federal Environment Agency at the beginning of 2025, which has been checked by an expert, and pay the subsequent fee notice. What does this mean for retailers outside of Germany ? All member states of the European Commission must transpose the EU directives into national law by the end of 2024. It is therefore essential that you check your legal situation, as you as the importer are responsible for this yourself. Foreign dealers or manufacturers who sell balloons directly to German end users must appoint an authorised representative based in Ger- many. However, they remain responsible for fulfi lling the manufacturer's obligations themselves. As the amount of the levies is based on waste analyses, we should work together to sensitise end consumers not to let balloons fl y or dis- pose of them carelessly in the environment. Because the more balloons are found, the more expensive the levy becomes. Waste data will be collected again in 2026 and higher quantities would inevitably lead to an increase in prices. 2
